2. Definitions

  • Service: the Speurtocht Plus website and app.
  • Maker: anyone who creates and publishes a hunt.
  • Player: anyone who plays a published hunt.
  • Hunt: a route with points, tasks and questions.
  • Publication: a frozen version of a hunt that players can play.
  • Seat: one place for one player in one published hunt.

3. The service

  • Creating and editing a hunt as a draft is free.
  • Publishing costs an amount per hunt, which includes a number of seats. You can buy more seats, with a discount on larger packs. You see the current prices and numbers at checkout.
  • A published hunt gets a play code and a QR code. Players play for free.
  • Seats belong to one hunt and do not expire. Publishing again, a new version of the same hunt, is free and keeps the seats. Anyone already playing keeps their version; anyone joining afterwards gets the new one.
  • A copy of a hunt is a new hunt with its own payment. Seats do not carry over.

4. Account

Makers log in with an email address, using a link we send. You are responsible for what happens through your account. Players can play without an account, as a guest. A guest has a session on their own device and no email address.

5. Paying

  • Payments are handled by Paddle, which acts as the reseller (merchant of record). Paddle processes the payment, the VAT and the invoice. The Paddle buyer terms also apply to the payment.
  • At checkout you see the price, including or excluding VAT as Paddle shows it for your country.
  • Seats cannot be moved to another hunt, transferred to someone else or sold back. So do not buy more at once than you think you need: a larger pack is cheaper per seat, but unused seats are not refunded.

6. Delivery and withdrawal

The service is delivered as soon as you publish the hunt. As a consumer you generally have 14 days to withdraw from a purchase. That right lapses for a digital service that has been delivered if, at checkout, you expressly agreed to immediate delivery and acknowledged that you thereby lose your right of withdrawal. Without that agreement the right applies as normal. More on this in the refund policy.

7. What we expect of a maker

A maker chooses the route and the points and is responsible for them. That means:

  • the route is safe and accessible for the players you make it for;
  • you have permission for points on private land or anywhere permission is needed;
  • children are supervised and their parents or carers know they are taking part. This is the maker's responsibility and not ours.

8. A maker's content

  • You remain the owner of what you make. You give us the right to store it and show it to the players of your hunt. Without that right we cannot provide the service.
  • Only use what you are allowed to use, and do not copy other people's texts without the right to.
  • Not allowed: unlawful, insulting, discriminatory or misleading content, content that is harmful to children, and information about people without their consent.
  • If a hunt does not meet this, we may take it offline or block access, with no refund. Where possible we tell you why first.
  • See something that is not acceptable? Email us at contact@speurtochtplus.nl. We do not check hunts in advance, but we act on reports.

9. Players' data

We are responsible for players' data. A maker sees what the privacy statement says (the name players entered and their answers), and may only use that for their own hunt. Using it for anything else, such as a mailing list or advertising, and sharing it with others, is not allowed.

10. Playing

  • You play at your own risk. Follow traffic rules and instructions on site.
  • Children play under the supervision of an adult.
  • The position on the map and the distance to a point come from your device's GPS and can be inaccurate.
  • Once downloaded, a hunt also works without reception. Downloading it and sending your results needs reception.

11. Availability and changes to the service

We do our best to keep the service available and reliable, but cannot guarantee it always works. We may change the service or carry out maintenance. A published version stays as it was; a correction means publishing again.

12. Liability

  • We provide a tool for scavenger hunts. The route, the points and the supervision belong to the maker; playing belongs to the player.
  • We are not liable for damage that occurs while playing a hunt, or because of a maker's choice of route or point.
  • Our liability for other damage is limited to the amount the maker paid for the hunt the damage relates to.
  • This applies as far as the law allows. For damage caused by our intent or deliberate recklessness, and for anything the law does not allow us to exclude, this limit does not apply.

13. Changes to these terms

We may change these terms. For an important change we tell makers by email at least 30 days ahead. If you do not agree, you can have your account deleted. What you have already bought keeps working under the terms that applied at the time.

14. Governing law and disputes

  • Dutch law applies to these terms.
  • Disputes with business customers, and with makers who are not consumers, go to the court of Noord-Nederland.
  • If you are a consumer, you can always bring a dispute before the court that has jurisdiction under the law.
  • If the Dutch and English texts differ, the Dutch text prevails.

15. Contact and complaints

Have a question or complaint? Email us at contact@speurtochtplus.nl. We usually reply within a few working days.
